Lies, Damn Lies and the Welfare Debate – Emily Thornberry

Next week the Government plans to bring forward a new Bill on welfare reform – the latest salvo in the Tories’ ongoing war of attrition on our welfare state and the principles that underpin it.

Softening up the ground for this next round of cuts, which will go further and deeper than anything we’ve seen so far, was a column written jointly by George Osborne and Iain Duncan Smith and published in the Sunday Times a few weeks ago.

The piece, which reads like a greatest hits compilation of clichéd Tory platitudes on welfare spending, was so shot through with errors, misleading implications and flat-out lies that it set the tone for the most ill-informed debate in recent memory.

So in the interest of setting the record straight, I’ve picked out my top eight tall Tory tales (there are many more than eight, but as space is limited I’ve kept myself to the worst offenders) and put them together with the actual facts. Without a willing handmaiden in the Murdoch press empire to help me, I’m relying on you to spread the word:

Lie number one:
“This country accounts for 7% of all welfare spending in the world, although we have just 1% of its population and produce 4% of its GDP.”

Even if you accept that these figures are accurate (and there’s no reason why you should – Osborne and Duncan Smith did not provide a source and I haven’t been able to find one) the implication – that we are spending more than we should because our welfare budget is out of proportion to our share of the global population – is ridiculous because it does not compare like with like.

To say that we spend more on welfare per head than, say, Somalia or Zimbabwe tells you nothing more than the fact that we have an advanced, industrialised economy, a domestic tax base, an established democracy and a modern welfare state, which many countries do not.

A much more valuable comparison would be between the UK and other industrialised democracies, for example within Europe. A comparison with the rest of Europe puts us below the average in terms of welfare spending as a proportion of GDP.

Lie number two:
Under Labour “Britain’s welfare bill was fast becoming completely unsustainable.”

Taking as a measure of “sustainability” the amount we spend on social security as a proportion of GDP (the most widely used measure), welfare spending stayed virtually flat during Labour’s time in office. Between 1998-99 and 2008-09 welfare spending represented on average 10.7% of GDP, never deviating more than 0.2% from this figure in any given year.

When the global financial crisis hit the proportion rose to 13% – a significant rise which nonetheless was neither surprising nor particularly concerning, given the historic tendency for welfare spending to rise during a depressed economy and fall back down to normal levels with the return of economic growth.

It’s also a bit rich for the Tories to preach about an increasing welfare budget when the bulk of social security expenditure in the UK goes to pensioners, an area where the Tories have increased spending, not cut it.

Lie number three:
“Not that any of this debt-fuelled largesse improved lives.”

Maybe not the lives of anybody the authors knew, but the truth is that, largely thanks to the support Labour provided to low-income working families through tax credits (which Osborne is about to gut), child poverty fell by a third under Labour – equivalent to more than a million children lifted out of poverty.

IDS may be busy redefining poverty so he can pretend it doesn’t exist, but I think most people can still understand that poverty is real, that it isn’t a good thing and that a person moving out of poverty would normally consider the change an improvement in their life.

Lie number four:
“The welfare system we inherited in 2010 trapped people in dependency and actively discouraged claimants from seeking work. All too often, those who worked hard and did the right thing were punished – while those who did the wrong thing were rewarded.”

Presumably what the authors mean by “doing the right thing” is working. But despite their best efforts to draw an artificial dividing line between “work” and “welfare”, the reality is that most people of working age who claim some kind of benefit do work. For example, more than two thirds of people claiming tax credits are employed, and tax credits account for around 50% of all spending on working-age welfare. Meanwhile, benefits specifically for people who are out of work, like Jobseeker’s Allowance and Income Support, make up just 3% of such spending.

The fact of the matter is that when governments fail – as the Tories have done – to tackle the root causes of working peoples’ need for welfare support, like low pay and high rents, the number of working people relying on benefits increases. For example, the proportion of housing benefit claimants who are employed has doubled since the Tories took office in 2010.

Lie number five:
“The new benefit cap of £26,000 a year means that no household can receive more in out-of-work benefits than the average working family earns, a simple matter of fairness.”

The Tories’ cap has nothing to do with fairness, as demonstrated by the fact that their new Bill abolishes the cap’s link with average earnings and gives Ministers carte blanche to lower the cap arbitrarily, at any time and for any reason.

Their cap also takes an across-the-board approach, affecting many more people who aren’t able to work – including people with disabilities, single mothers with young children and people with full-time caring responsibilities for sick or severely disabled relatives – than people who are.

Lie number six:
“We also took action to cap the rise in benefits so it was in line with the incomes of those in work.”

They did no such thing. Since 1980, the main out-of-work benefits have risen in line with prices, rather than earnings. So Jobseeker’s Allowance fell from being worth a fifth of average earnings in 1980 to a tenth in 2010.

Lie number seven:
“In 1980, working age welfare accounted for 8% of all public spending. In 1990, when Margaret Thatcher left office, it was still under 10%. But by 2010 it had risen to nearly 13% of public spending.”

Similar to lie number two, but since the lie is repeated (or, to put it more charitably, the highly selective and misleading half-truth) the truth might as well be repeated too. As noted, welfare reform stayed virtually flat under Labour until a sudden increase was brought about as a result of a recession – just as had happened in the early 1990s under John Major’s Government.

Lie number eight:
“This government was elected with a mandate to implement further savings from the £220 billion welfare budget.”

They most certainly were not. The Tories ran on a manifesto promising £12billion worth of welfare cuts, a figure which no-one took seriously in large part because they failed to specify where the savings would come from.

A brief history of social security and the reintroduction of eugenics by stealth

Introduction

Our welfare state arose as a social security safety net – founded on an assurance that as a civilised and democratic society we value the well-being and health of every citizen.

There was a cross-party political consensus that such provision was in the best interests of the nation as a whole at a time when we were collectively spirited enough to ensure that no one should be homeless or starving in modern Britain.

As such, welfare is a fundamental part of the UK’s development –  our progress – the basic idea of improving people’s lives was at the heart of the welfare state and more broadly, it reflects the evolution of European democratic and rights-based societies.

Now the UK “social security” system is anything but. It has regressed to reflect the philosophy underpinning the 1834 Poor Law, to  become a system of punishments aimed at the poorest and most marginalised social groups. The Poor Law principle of less eligibility – which served as a deterrence to poor people claiming poor relief is embodied in the Conservative claim of Making work pay: benefits have been reduced to make the lowest paid, insecure employment a more appealing option than claiming benefits.

Unemployed people have absolutely no bargaining power or choice regarding their work conditions and pay. They are coerced by the state to apply for any work available. This also negatively impacts on collective bargaining more widely, the creation of a desperate reserve army of labor serves to drive wages down further. (See: Conservatism in a nutshell.)

The draconian benefit sanctions are about depriving people of their lifeline benefits because they have allegedly failed to comply in some way with increasingly stringent welfare conditionality – which is aimed at enforcing compliance, “behaviour change” and achieving reductions in welfare expenditure rather than supporting people claiming benefits and helping them to find work.

Removing a person’s means of meeting basic survival needs presents significant barriers to that person finding work. If we can’t meet our basic needs, we cannot be motivated or “incentivised” to do anything but struggle for survival.

Such a political aim of “behaviour change” is founded entirely on assumptions and moral judgements about why people are unemployed or underpaid. And of course serious concerns have arisen because sanctions have tended to be extremely discriminatory. Young people, women with childcare responsibilities, people with learning disabilities, people with mental illnesses and disabled people are particularly vulnerable as a consequence of the rigid conditionality criteria.

Frankly, such an approach to welfare seems to be cruelly designed to exclude those people who need support the most. Not only does the current government fail to recognise socio-economic causes of poverty, poor wages, underemployment and unemployment because of political decision-making – preferring to blame individuals for economic misfortune – it also fails to recognise the detrimental wider social and economic implications of penalising poor people for the conservative engineering of a steeply hierarchical society.

As a government that values social inequality, and regards it as necessary for economic growth, insolvency and poverty for some is intrinsic to the Conservative ideological script and drives policy decisions, yet the Tories insist that individuals shape their own economic misfortunes.

Worse, the Conservatives are prepared to leave people without a basic means of support – one that the public have paid for themselves.

Austerity – which is aimed at the poorest members of society – has served to increase inequality, and since the Tory welfare “reforms,” we have seen a re-emergence of absolute poverty. Up until recently, our welfare system ensured that everyone could meet their basic survival needs. That no longer is the case.

A brief history of welfare

A welfare state is founded on the idea that  government plays a key role in ensuring the protection and promotion of the economic and social well-being of its citizens. It is based on the principles of equality of opportunity, equitable distribution of wealth, and both political and social responsibility for those unable to avail themselves of the minimal provisions for well-being.

It was recognised that people experienced periods of economic difficulty because of structural constraints such as unemployment and recession, through no fault of their own. It was also recognised that poor health and disability may happen to anyone through no fault of their own.

The welfare state arose in the UK during the post-war period, and following the Great Depression, for numerous reasons, most of these were informed by research carried out into the causes of poverty, its effects on individuals and more broadly, on the UK economy. There were also political reasons for the Conservatives and Liberals supporting the poorer citizens – the newly enfranchised working class.

Charles Booth in London and Sebohm Rowntree in York carried out the first serious studies of poverty and its causes. They both discovered that the causes were casual labour, low pay, unemployment, illness and old age – not laziness, fecklessness, drunkenness and gambling, as previously assumed. The poverty studies raised awareness of the extent of poverty in Britain and the myriad social problems it caused.

The Boer war of 1899-1902 highlighted the general poor state of health of the nation. One out of every three volunteers failed the army medical due to malnutrition, other illnesses due to poor diet and very poor living conditions. The military informed the government at the time of the shockingly poor physical condition of many of those conscripted.

It was realised that the effects of poverty were potentially damaging to  the whole of society. Health problems and infectious disease – rife in the overcrowded slums – could affect rich and poor alike. It was recognised that the economy suffered if large numbers of people were too poor to buy goods and social problems such as exploitation, debt, crime, prostitution and drunkenness were a direct result of poverty, and not the cause of it.

The discovery of  widespread poor health as a consequence of poverty raised concerns about Britain’s future ability to compete with new industrial nations such as Germany and the USA. National efficiency would only increase if the health and welfare of the population improved.

The growth of the Labour Party and Trade Unionism presented a threat to the Liberals and the Conservatives. The new working class voters were turning to these organizations to improve their lives. The traditionally laissez-faire Liberals recognised this and supported the idea of government help for the working class.

Back to the present: welfare is no longer about welfare

The current Conservative government has taken a distinctly behaviourist turn – a form of psychopolitics which essentially reduces explanations of poverty to the personal – blaming poor people for poverty and unemployed people for unemployment, formulating policies that are about making people change their behaviour, based on a simplistic “cause and effect” approach. The government nudges and we are expected to comply. Increasing the use of benefit sanctions is one policy consequence of this psychopolitical approach.

Of course this brand of psychopolitics is all about the government assuming the fallibility of the population and the infallibility of the government when it comes to decision-making and behaviours.

Although Cameron claims that “Nudge” draws on a “paternalistic libertarian” philosophy, any government that acts upon a population, by reducing liberties, choices and by imposing behavioural modification without public consent – expecting people to change their behaviours and choices unwittingly to fit with what the state deems “right,” rather than reflecting public needs via democratic engagement and a genuine dialogue, is actually authoritarian.

As I’ve said elsewhere, welfare has been redefined: it is pre-occupied with assumptions about and modification and monitoring of the behaviour and character of recipients, rather than with the alleviation of poverty and ensuring economic and social well-being.

Eugenics by stealth

Further intention of directing behavioural change is at the heart of policies that restrict welfare support such as tax credits to two children. The Conservatives have recently announced plans to cut welfare payments for larger families. Whilst this might not go as far as imposing limits on the birth of children for poor people, it does effectively amount to a two-child policy.

A two-child policy is defined as a government-imposed limit of two children allowed per family or the payment of government subsidies only to the first two children.

Of course this is justified using a Conservative ideologically driven scapegoating narrative of the feckless family, misbehaving and caught up in a self-imposed culture of dependence on welfare.

This restriction in support for children of larger families, however, significantly impacts on the autonomy of families, and their freedom to make decisions about their family life. Benefit rules purposefully aimed at reducing family size rarely come without repercussions.

It’s worth remembering that David Cameron ruled out cuts to tax credits before the election when asked during interviews. Tax credit rates weren’t actually cut in the recent Budget—although they were frozen and so will likely lose some of their value over the next four years because of inflation.

Some elements were scrapped, and of course some entitlements were restricted. But either way a pre-election promise not to cut child tax credits sits very uneasily with what was announced in the budget.

Iain Duncan Smith said last year that limiting child benefit to the first two children in a family is “well worth considering” and “could save a significant amount of money.” The idea was being examined by the Conservatives, despite previously being vetoed by Downing Street because of fears that it could alienate parents. Asked about the idea on the BBC’s Sunday Politics programme, Duncan Smith said:

“I think it’s well worth looking at,” he said. “It’s something if we decide to do it we’ll announce out. But it does save significant money and also it helps behavioural change.”

Firstly, this is a clear indication of the Tories’ underpinning eugenicist designs – exercising control over the reproduction of the poor, albeit by stealth. It also reflects the underpinning belief that poverty somehow arises because of faulty individual choices, rather than faulty political decision-making and ideologically driven socio-economic policies.

Such policies are not only very regressive, they are offensive, undermining human dignity by treating children as a commodity – something that people can be incentivised to do without.

Moreover, a policy aimed at restricting support available for families where parents are either unemployed or in low paid work is effectively a class contingent policy.

The tax child credit policy of restricting support to two children seems to be premised on the assumption that it’s the same “faulty” families claiming benefits year in and year out. However, extensive research indicates that people move in and out of poverty – indicating that the causes of poverty are structural rather than arising because of individual psychological or cognitive deficits.

The Joseph Rowntree Foundation published a study that debunked  the notion of a “culture of worklessness” in 2012.  I’ve argued with others more recently that there are methodological weaknesses underlying the Conservative’s regressive positivist/behaviourist theories, especially a failure to scientifically test the permanence or otherwise of an underclass status, and a failure to distinguish between the impact of “personal inadequacy” and socio-economic misfortune.

Back in the 1970s, following his remarks on the cycle of deprivation, Keith Joseph established a large-scale research programme devoted to testing its validity. One of the main findings of the research was that there is no simple continuity of social problems between generations of the sort required for his thesis. At least half of the children born into disadvantaged homes do not repeat the pattern of disadvantage in the next generation.

Despite the fact that continuity of deprivation across generations is by no means inevitable – the theory is not supported by empirical research – the idea of the cycle of “worklessness” has become “common sense.” Clearly, common perceptions of the causes of poverty are (being) misinformed. The individual behaviourist theory of poverty predicts that the same group of people remain in poverty. This doesn’t happen.

However, the structural theory predicts that different people are in poverty over time (and further, that we need to alter the economic structure to make things better). Longitudinal surveys show that impoverished people are not the same people every year. In other words, people move in and out of poverty: it’s a revolving door, as predicted by structural explanations of poverty.

Many families are in work when they plan their children. Job loss, an accident or illness causing disability, can happen to anyone at any time. It’s hardly fair to stigmatise and penalise larger families for events that are outside of their control.

Limiting financial support to two children may also have consequences regarding the number of abortions. Abortion should never be an outcome of reductive state policy. By limiting choices available to people already in situations of limited choice – either an increase of poverty for existing children or an abortion, then women may feel they have no choice but to opt for the latter. That is not a free choice, because the state is inflicting a punishment by withdrawing support for those choosing to have more than two children, which will have negative repercussions for all family members.

Many households now consist of step-parents, forming reconstituted or blended families. The welfare system recognises this as assessment of household income rather than people’s marital status is used to inform benefit decisions. The imposition of a two child policy has implications for the future of such types of reconstituted family arrangements.

If one or both adults have two children already, how can it be decided which two children would be eligible for child tax credits?  It’s unfair and cruel to punish families and children by withholding support just because those children have been born or because of when they were born.

And how will residency be decided in the event of parental separation or divorce – by financial considerations rather than the best interests of the child? That flies in the face of our legal framework which is founded on the principle of paramountcy of the needs of the child. I have a background in social work, and I know from experience that it’s often the case that children are not better off residing with the wealthier parent, nor do they always wish to.

Restriction on welfare support for children will directly or indirectly restrict women’s autonomy over their reproduction. It allows the wealthiest minority to continue having babies as they wish, whilst aiming to curtail the poor by disincentivisingbreeding” of the “underclass.” It also imposes a particular model of family life on the rest of the population. Ultimately, this will distort the structure and composition of the population, and it openly discriminates against the children of large families.

People who are in favour of eugenics believe that the quality of a race can be improved by reducing the fertility of “undesirable” groups, or by discouraging reproduction and encouraging the birth rate of “desirable” groups.

Eugenics arose from the social Darwinism and laissez-faire economics of the late 19th century, which emphasised competitive individualism, a “survival of the wealthiest” philosophy and sociopolitical rationalisations of inequality.

Eugenics is now considered to be extremely unethical and it was criticised and condemned widely when its role in justification narratives of the Holocaust was revealed.

But that doesn’t mean it has gone away. It’s hardly likely that a government of a so-called first world liberal democracy – and fully signed up member of the European Convention on Human Rights and a signatory also to the United Nations Universal Declaration – will publicly declare their support of eugenics, or their totalitarian tendencies, for that matter, any time soon.

But any government that regards some social groups as “undesirable” and formulates policies to undermine or restrict that group’s reproduction rights is expressing eugenicist values, whether those values are overtly expressed as “eugenics” or not.

Conservatives are not known for valuing diversity, it has to be said.

Implications of the welfare “reforms”: Human rights

Article 25 of the Universal Declaration of Human Rights, of which the UK is a signatory, reads:

  1. Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control.
  2.  Motherhood and childhood are entitled to special care and assistance. All children, whether born in or out of wedlock, shall enjoy the same social protection.

A recent assessment report by the four children’s commissioners of the UK called on the government to reconsider its deep welfare cuts, voiced “serious concerns” about children being denied access to justice in the courts, and called on ministers to rethink plans to repeal the Human Rights Act.

The commissioners, representing each of the constituent nations of the UK, conducted their review of the state of children’s policies as part of evidence they will present to the United Nations.

Many of the government’s policy decisions are questioned in the report as being in breach of the convention, which has been ratified by the UK.

England’s children’s commissioner, Anne Longfield, said:

“We are finding and highlighting that much of the country’s laws and policies defaults away from the view of the child. That’s in breach of the treaty. What we found again and again was that the best interest of the child is not taken into account.”

Another worry is the impact of changes to welfare, and ministers’ plan to cut £12bn more from the benefits budget. There are now 4.1m children living in absolute poverty – 500,000 more than there were when David Cameron came to power.

It’s noted in the report that ministers ignored the UK supreme court when it found the “benefit cap” – the £25,000 limit on welfare that disproportionately affects families with children, and particularly those with a larger number of children – to be in breach of Article 3 of the convention – the best interests of the child are paramount:

“In all actions concerning children, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities or legislative bodies, the best interests of the child shall be a primary consideration.”

The United Nation’s Convention on the Rights of the Child (UNCRC) applies to all children and young people aged 17 and under. The convention is separated into 54 articles: most give children social, economic, cultural or civil and political rights, while others set out how governments must publicise or implement the convention.

The UK ratified the Convention on the Rights of the Child (UNCRC) on 16 December 1991. That means the State Party (England, Scotland, Wales and Northern Ireland) now has to make sure that every child benefits from all of the rights in the treaty. The treaty means that every child in the UK has been entitled to over 40 specific rights. These include:

Article 1

For the purposes of the present Convention, a child means every human being below the age of eighteen years unless under the law applicable to the child, majority is attained earlier.

Article 2

1. States Parties shall respect and ensure the rights set forth in the present Convention to each child within their jurisdiction without discrimination of any kind, irrespective of the child’s or his or her parent’s or legal guardian’s race, colour, sex, language, religion, political or other opinion, national, ethnic or social origin, property, disability, birth or other status.

2. States Parties shall take all appropriate measures to ensure that the child is protected against all forms of discrimination or punishment on the basis of the status, activities, expressed opinions, or beliefs of the child’s parents, legal guardians, or family members.

Article 3

1. In all actions concerning children, whether undertaken by public or private social welfare institutions, courts of law, administrative authorities or legislative bodies, the best interests of the child shall be a primary consideration.

2. States Parties undertake to ensure the child such protection and care as is necessary for his or her well-being, taking into account the rights and duties of his or her parents, legal guardians, or other individuals legally responsible for him or her, and, to this end, shall take all appropriate legislative and administrative measures.

3. States Parties shall ensure that the institutions, services and facilities responsible for the care or protection of children shall conform with the standards established by competent authorities, particularly in the areas of safety, health, in the number and suitability of their staff, as well as competent supervision.

Article 4

States Parties shall undertake all appropriate legislative, administrative, and other measures for the implementation of the rights recognized in the present Convention. With regard to economic, social and cultural rights, States Parties shall undertake such measures to the maximum extent of their available resources and, where needed, within the framework of international co-operation.

Article 5

States Parties shall respect the responsibilities, rights and duties of parents or, where applicable, the members of the extended family or community as provided for by local custom, legal guardians or other persons legally responsible for the child, to provide, in a manner consistent with the evolving capacities of the child, appropriate direction and guidance in the exercise by the child of the rights recognized in the present Convention.

Article 6

1. States Parties recognize that every child has the inherent right to life.

2. States Parties shall ensure to the maximum extent possible the survival and development of the child.

Article 26

1. States Parties shall recognize for every child the right to benefit from social security, including social insurance, and shall take the necessary measures to achieve the full realization of this right in accordance with their national law.

2. The benefits should, where appropriate, be granted, taking into account the resources and the circumstances of the child and persons having responsibility for the maintenance of the child, as well as any other consideration relevant to an application for benefits made by or on behalf of the child.

The Nordic social democratic model of welfare

Finally, it’s worth noting, as sociologist Lane Kenworthy has pointed out, that the Nordic welfare experience of the modern social democratic model can:

“promote economic security, expand opportunity, and ensure rising living standards for all . . . while facilitating freedom, flexibility and market dynamism.”

Nordic welfare models include support for a universalist welfare state which is aimed specifically at enhancing individual autonomy, promoting social mobility and ensuring the universal provision of basic human rights, as well as for stabilizing the economy, alongside a commitment to free trade.

The Nordic model is distinguished from other types of welfare states by its emphasis on maximizing labor force participation, promoting gender equality, egalitarian and extensive benefit levels and the large magnitude of income redistribution.

Nobel Prize-winning economist Joseph Stiglitz has noted that there is higher social mobility in the Scandinavian countries than in the United States, and argues that Scandinavia is now the land of opportunity that the United States once was. The Nordics cluster at the top of league tables of everything from economic competitiveness to social health to happiness.

They have avoided both southern Europe’s economic sclerosis and America’s extreme inequality. Development theorists have taken to calling successful modernisation “getting to Denmark”.

The Nordics demonstrate very well that it is possible to combine competitive capitalism with a large state: they employ 30% of their workforce in the public sector, compared with an OECD average of 15%. The main lesson to learn from the Nordics is not ideological but practical.

The state is popular not because it is big but because it works. A Norwegian pays tax more willingly than a Californian because he or she has access to decent schools, support when times are difficult and free health care as a result.

Norway ranks among the richest countries in the world. GDP per capita is among the highest in the world.

Norway regards welfare services not as social costs but as fundamental social investment for open innovation and growth.

Innovation should not be an opportunity for a few only. It should be democratised and distributed in order to tackle the causes of growing inequality.

Inequality hampers economic growth.

We can’t afford not to have a welfare state.

The welfare state: from hung, drawn and quartered to Tory privatisation

The mess that Thatcher left in her wake is verified by several longitudinal studies. Dr. Alex Scott-Samuel and colleagues from the Universities of Durham, West of Scotland, Glasgow and Edinburgh, sourced data from over 70 existing research papers, which concludes that as a result of unnecessary unemployment, welfare cuts and damaging housing policies, the former prime minister’s legacy:

includes the unnecessary and unjust premature death of many British citizens, together with a substantial and continuing burden of suffering and loss of well-being. 

The article also cites evidence including the substantial increase in income inequality under Thatcher – the richest 0.01% of society had 28 times the mean national average income in 1978 but 70 times the average in 1990, and there was a rise in UK poverty rates from 6.7% in 1975 to 12% in 1985.

The research article concludes that:

Thatcher’s governments wilfully engineered an economic catastrophe across large parts of Britain by dismantling traditional industries such as coal and steel in order to undermine the power of working class organisations, such as unions.This ultimately fed through into growing regional disparities in health standards and life expectancy, as well as greatly increased inequalities between the richest and poorest in society.

New Right Conservatives have a curiously evidence-resistant conviction that the “big state” has somehow stymied our society: that the “socialist relic” – our NHS and our Social Security system, which supports the casualties of Tory free markets, have somehow created those casualties. But we know from history and recent events that competitive individualism and market choice-driven Tory policies create a few haves and many have-nots.

Tory rhetoric is designed to have us believe there would be no poor if the welfare state didn’t somehow “create” them. If the Conservatives must insist on peddling the myth of meritocracy, then surely they must also concede that whilst such a system has some beneficiaries, it also creates situations of insolvency and poverty for others.

In a wealthy so-called first world democracy, it is profoundly uncivilised and anti-democratic to simply dismiss people experiencing poverty and hardship effectively as collateral damage, and terribly cruel and irresponsible to blame those people for the situations of difficulty and deprivation created by policies and the socio-economic framework itself.

This wide recognition that the raw “market forces” of stark laissez faire cause casualties is why the welfare state came into being, after all – because when we allow such competitive economic dogmas to manifest – as the stormy present – there are winners and losers. That is the nature of competitive individualism, and along with inequality, it’s an implicit, undeniable and fundamental part of the meritocracy script.

And that’s before we consider the fact that whenever there is a Conservative-led government, there is no such thing as a “free market”: in reality, all markets are rigged to favour elites.

Cameron is continuing to build on Thatcher’s legacy. We know from the Central Policy Review Staff (CPRS) report, which was encouraged and commissioned by Margaret Thatcher and Geoffrey Howe in 1982, that there was a radical, politically toxic plan to dismantle the welfare state, to introduce education vouchers, ending the state funding of higher education; to freeze welfare benefits and to introduce an insurance-based health service, ending free health care provision of the NHS. One of the architects of the report was Lord Wasserman, he  was one of Cameron’s advisors until 2012.

A confidential cabinet memorandum by the Central Policy Review Staff in September 1982, said: “This would of course mean the end of the National Health Service.” The report was declassified and released in 2012 by the National Archives under the 30-year rule.

But the fear of the scale of opposition to the plan meant the grand dismantling of the welfare state didn’t happen. Instead the Conservatives have planned and worked to take it apart a piece at a time.

In 1982 unemployment rose above three million. Yet the Tories were happy with further increases to try and drive down wages. John Sparrow of the Cabinet Office’s Central Policy Review Staff think-tank, wrote in a June memo to Thatcher that the youth training scheme, introduced in 1983, would be “likely to displace some older workers”.

He continued:

Displacement is not necessarily a bad thing, since it puts downward pressure on wage rates.” Sparrow noted that government plans to end out-of-work benefits for 16 year olds would remove them from the unemployment figures.

Fast-forward to the present: David Cameron is prepared to consider making workers pay into flexible saving accounts to self-fund periods of illness and unemployment benefits, Downing Street has confirmed.

The idea was first floated by Iain Duncan Smith who said he was “very keen” to have a debate about encouraging people to use personal accounts to save for unemployment or illness, even though it is not “official” government policy.

Duncan Smith told the Sunday Telegraph:

We need to support the kind of products that allow people through their lives to dip in and out when they need the money for sickness or care or unemployment.

We need to encourage people to save from day one but they need to know that they can get some of the money out when their circumstances change. This is not government policy but I am very keen to look at it, as a long-term way forward for the 21st century.

Duncan Smith seems to be suggesting that benefits are replaced with a kind of unemployment insurance scheme as seen in the US or products known as “fortune accounts”, which are used in Singapore.

Asked about the idea of workers saving up for their sickness and unemployment benefits, Cameron’s official spokeswoman confirmed he was prepared to consider such a model. She said:

I think the PM shares the work and pensions secretary’s view that we should be doing more to encourage people to take personal responsibility for how they manage their affairs.

The proposal of fortune accounts for the UK was examined in depth in a paper by the Right-wing libertarian Adam Smith Institute thinktank in 1995, which considered how people could go to a single private provider for an account that gave them long-term care insurance, disability cover, health insurance, savings fund management and unemployment insurance.

The paper suggested:

Many other things that we often regard as ‘welfare’ today are also insurable and will be part of the fortune account package. Cover against incapacity to work, long-term care services, and disability, will all be in the package.

A report from Civitas argued (preemptively) that National Insurance is “no longer fit for purpose” and that everyone in work should be forced to save into a private pension to help shoulder the burden of the rising costs of old age.

Civitas professorial research fellow Peter Saunders argued in the report, titled Beyond Beveridge, that the principle that those who are able to should pay into the system has been eroded and “taxpayer-funded hand-outs” have increasingly replaced contributions-based benefits.

He goes on to say that whilst the main purpose of the proposed personal welfare accounts would be for retirement saving, they could also provide cover for when times are tough during periods of short-term unemployment, sickness and parental leave.

It reads like Daily Mail dogma to me.

accounts.”

The introduction of personal insurance schemes would mark the end of welfare provision as we know it. Furthermore, those least likely to be able to afford the premiums are those most at risk of losing their jobs.

The Tories fully intended that the welfare “reforms” were the beginning of the end of our welfare state. The welfare cuts were ushered in strictly because of the despotic use of “financial privilege” by Cameron to bypass the widespread and vehement opposition to the Bill.

At the time, such was my dismay at the proposed welfare “reform” Bill that I emailed the entire House of Lords, imploringly. After using a reasoned approach, my second email simply said: the welfare reforms must not happen. Many of the peers and members replied, and many responded with “agreed.” But Cameron made the “reforms” happen anyway and apparently felt no obligation to observe the niceties of democratic process.

The Tories clearly have no intention of ensuring a safety net for citizens and have plotted to dismantle our welfare state since the Thatcher era. This is a long-planned outcome for the Tories. Social security and public services are in serious jeopardy.

Cameron’s rhetoric is full of references to “rolling back the state”, the “re-awakening of community spirit”, and a restoration of the kind of “intermediate civic institutions” that preceded the welfare state. The whole idea of Cameron’s “big society” is that private charities fill the holes created by public spending cuts.

Food banks have increasingly replaced welfare, for example, yet the point of post-1945 European welfare states was to free those in need from dependence on the insecurity of private generosity, which tends to miss out the socially marginalised, and to be least available when times are hardest.

Welfare, or social security, if you prefer, has provided a sense of security and dignity that we never previously enjoyed, it established a norm of decency, mutuality of our social obligations and created a parity of esteem and worth which was, until fairly recently, universal, regardless of wealth and status.

The “big bad state” is comprised of civilised and civilising institutions. It is such stable and enduring institutions and subsequently secure individuals that are raised above a struggle for basic survival which provide a frame for coherent communities. The Conservatives, with their anti-humanist, anti-enlightenment demagoguery of rigid class division, and policies that engineer steep social stratification, tend to create ghettoes, not communities.

The paternalism of traditional Tories and the authoritarianism of the current New Right are profoundly undemocratic: neither design can reflect the needs of the public since both frameworks are imposed on a population, reflecting only the needs of the ruling class, to preserve social order.

Conservative small-state ideology has led to depopulated social policies, which have dehumanised people, and indicate that the Tory policy-makers see the public as objects of their policies, and not as human subjects.

The moralising scrutiny and control of the poor is a quintessential element of tory narrative. Tory ideology never changes. They refuse the lessons of history, and reject the need for coherence and rationality. Tories really are stuck in the Feudal era. They have never liked the idea of something for everyone, yet everyone has paid for welfare provision:

“The [financial] crisis is an opportunity to sweep away the rotten postwar settlement of British politics. Labour is moribund. But David Cameron has a chance to develop a “red Tory” communitarianism, socially conservative but sceptical of neoliberal economics.” Phillip Blond, The Rise of the Red Tories, 2009.

Cameron was never sceptical of neoliberalism: like Thatcher, he has extended it without restraint. Neoliberalism entails a charismatic ideology – what sociologist Pierre Bourdieu calls a doxa: an unquestionable orthodoxy that operates as if it were the objective truth – that facilitates an uncompromising attack on public welfare; inevitable, growing inequality, and the individualization of all social actions, all in the name of private “enterprise”, the accummulation of private wealth for a minority and “global competitiveness.”

Unsurprisingly, then, unemployment, inequality, and poverty are increasingly blamed on the individuals experiencing these conditions rather than on the structural constraints that create the conditions.

We are being turned away from the role of the community and instead our attention is being purposefully diverted and re-focused solely on the “responsibilities” of individuals (and those responsiblities are inversely proportional to how much wealth a person has), common social values such as cooperation, mutual support, reciprocal altruism are being eroded, and the interdependent and intersubjective nature of social life is flatly denied: mutual relationships and common bonds are being dissolved and replaced by a social Darwinist narrative – founded on the mantra of competitive individualism.

The policies, practices and irrational beliefs of the state are distorting the perceptions of social groups and individuals, the colonisation of public language and space with neoliberal narratives – facilitated by a largely complicit media – delivers a distinctive anti-rationalist epistemology that restructures public ontological understandings.

Those understandings have become profoundly anti-collectivist and increasingly, antisocial, ultimately undermining social cohesion, stability and social security.

Benefit cuts “will involve cuts to benefits” shocker

There was widespread shock across Britain today that the £12 billion of welfare cuts promised in the Tory election manifesto would turn out to be £12 billion of cuts to the welfare budget.

“We definitely didn’t think these 12 billion worth of cuts would involve people like us,” said one first-time Tory voter, having her child tax credits halved.

“We thought it would only affect those wretched people on those awful benefit shows on Channel 4.” https://upload.wikimedia.org/wikipedia/en/b/bb/Benefits_Street.jpg “We feel utterly betrayed by the Tories,” said another father, who is having his family working tax credits slashed.

“Why didn’t Osborne say these 12 billion worth of cuts would affect me? I naturally assumed it would hit people in the North, guests on the Jeremy Kyle show and muslims. That’s why I voted Tory.”

George Osborne has insisted he’d worked hard to ensure that the cuts to benefits were spread evenly between those people most likely to vote Labour and those most likely to vote Lib Dem.

Child protection must not be used for dealing with the symptoms of increased poverty

According to a recent report by the Joseph Rowntree Foundation, 39% of people in households with children now live below the Minimum Income Standard. The figure has risen by over a third since 2008/09.

Families with children are now at greater risk than any other group of having an inadequate income and the number of homeless families living in bed and breakfast accommodation has risen by 300% over the last five years as a direct result of austerity.

Humiliation, shame, fear, distrust, instability, insecurity, isolation,  loneliness and feelings of being trapped and powerless are widespread features of the social and emotional landscapes of individuals and their families in a world of benefit sanctions, zero hours contracts and precarious housing.

Small wonder that relations between family members, including those between parents and their children, can become increasingly fraught in such circumstances.

Child protection need rising

Meanwhile, figures published last week in CYP Now, using official statistics and new figures obtained under an FOI, show the number of children being looked after by the state rose by 8% under the coalition government. The number of children placed on child protection plans rose by 33% while the number of Section 47 inquiries rose by a staggering 42%.

The links between poverty and a child’s chances of becoming subject to child protection processes or being looked after are undeniable according to the international and national research.

A child in the most deprived decile of neighbourhoods nationally has an 11 times greater chance of being on a child protection plan and 12 times greater chance of being a looked after child than a child living in the most affluent decile.

‘Wholly inappropriate’ use of child protection

We hear regularly about the impact of reduced services and benefit cuts on the capacity of families to cope and to care.

We hear of cash strapped local authorities who do not have the services to support families within communities.

We are, therefore, increasingly concerned that the child protection system is being used in a wholly inappropriate way to deal with the consequences of austerity and of policies that are depriving children and their families of food, housing and basic support services.

The effects of austerity are exacerbated by the continued existence of a risk-averse climate despite increasingly heroic efforts by local authorities to develop more strengths based approaches.

‘Long on blame, short on help’

Thus, families are experiencing practices that are long on blame and short on help in too many instances as a recent conference organised by the Transparency Project, involving lawyers, other professionals and family members, discussed.

The policy commitment to adoption, reaffirmed in recent days, is extremely worrying in a context where many birth families are unable to access what is needed in terms of material, emotional and social supports to care safely.

This is leading to increased concern across the sector and, indeed, more widely.

Pause for thought

Individual court rulings have drawn attention to judicial comments where social workers have been asked to think again about the importance of relational bonds and children’s identities and to desist from social engineering, and the UK has been specifically criticized this year by the Council of Europe for its removal of children from women who have been subject to domestic abuse, or who are suffering from depression (Report 1 Committee on Social Affairs, Health and Sustainable Development, 2015).

Such women are particularly vulnerable in the current climate where services for domestic abuse are very stretched.

The evidence is mounting that we need to pause and make vital links between wider economic and social policies and the harms that children and their families experience. The child protection system must not be a system for dealing with the symptoms of increased impoverishment.

Osborne’s razor: the Tory principle of parsimony is applied only to the poorest

The BBC reports that leaked documents from the Department for Work and Pensions suggest the government is planning a regional benefits cap, reducing child benefit, taxing disability benefits and reducing eligibility for the carers’ allowance. The proposals are aimed at helping to save £12 billion from the welfare budget by 2017/18. The Conservatives have of course insisted that the proposals were “not party policy.” Yet. They dismissed the leaked report as “ill-informed and inaccurate speculation.”

However, the documents were prepared by civil servants and commissioned by Conservative Party officials. These are the key proposals in the report:

  • Industrial Injuries Compensation Scheme – could be replaced by companies providing industrial injury insurance policy for employees. Any that did not would become members of a default national industrial injuries scheme, similar to the programme for asbestos sufferers. DWP predicted saving – £1bn
  • Carer’s Allowance – this could be restricted to those eligible for Universal Credit. Leaked documents suggest about 40% of claimants would lose out. DWP predicted saving – £1bn
  • The contributory element of Employment and Support Allowance and Job Seekers Allowance – currently claimants who have paid enough National Insurance contributions can get the benefits with little means testing; DWP analysis suggests 30% of claimants, over 300,000 families, would lose about £80 per week. DWP predicted saving – £1.3bn in 2018/19
  • Disability benefits – Disability Living Allowance, Personal Independence Payments and Attendance Allowance (for over 65s who have personal care needs) would no longer be paid tax free. Possible saving – £1.5bn per annum (based on IFS Green Budget calculation )
  • Council Tax Support – to be incorporated into Universal Credit. Possible saving – not known
  • Child Benefit – Limiting the benefit to the first two children. Possible saving IFS estimates £1bn saving per annum in the long run but little initially
  • Regional Benefit Caps – The £23,000 limit would vary in different parts of the country, with for instance Londoners receiving the top amount due to the higher cost of living. Possible saving – not known and dependent on where levels were set

Meetings about these options have taken place in recent weeks between the chancellor and Iain Duncan Smith. It is also understood that the permanent secretary, Sir Jeremy Heywood, has been coordinating some of the efforts to find savings.

The government has cut around £20bn from projected welfare spending over the course of the past five years, through a range of measures from freezing payments rates to cutting housing benefit. But Robert Joyce, a senior economist with the IFS, says finding another £12bn over the next two years will not be easy.

The easier benefit cuts are the ones that will have been done first, so what’s left will be harder.

“In addition, the Conservatives want to do this by 2017-18, in the next two years. It means they have to be looking at less palatable options that would involve overnight takeaways from certain families.”

Shadow work and pensions secretary, Rachel Reeves, said the Conservatives now needed to explain how they would achieve the welfare savings they needed to make.

She said: “These plans to hit the disabled and carers were drawn up for Conservative ministers to deliver their extreme cuts plan.” “The Tories now need to come clean about what cuts they plan to make and who will pay the price. If they are ruling out these extreme cuts for the most disabled and carers, then it is clear they will be hitting the tax credits, and support for children, for millions of working families.”

Rosanna Trudgian, policy officer at the charity Mencap, said the proposed changes were unfair. “Disabled people don’t choose to have their disability. They don’t choose to pay for these additional costs related to that disability,” she told BBC News.

“For example, if you have to go to hospital on a regular basis and you are paying for those huge car parking fees. Therefore, it’s just unfair if this is treated as taxable income.”

These cuts would hit the elderly, disabled people, poor people, especially those with large families, and those injured at work – and would devastate many communities.

Earlier this week, the Institute for Fiscal Studies (IFS) has asked Osborne to specify how he will reach targets announced in the budget, given that the poorest had been the hardest hit by draconian benefit cuts already. The IFS say the worst of the UK’s spending cuts are still to come.

I proposed that, as a society, we cannot possibly accommodate a further 12 billion cut from welfare spending. It’s not that Osborne can’t answer the IFS challenge: he won’t. He’s being conservative with the truth – which is that we cannot afford to reduce any more from welfare without ending welfare provision as we know it.

David Cameron promised a further £7.2 BILLION tax cuts to the rich at the expense of the poor

I wrote an article last year – Follow the Money: Tory Ideology is all about handouts to the wealthy that are funded by the poor – which outlines Coalition policies that have widened inequalities and increased poverty by handing out public money to the wealthy that has been taken from the poorest. I pointed out that this Government have raided our tax-funded welfare provision and used it to provide handouts to the very wealthy – £107,000 EACH PER YEAR in the form of a tax break for millionaires, amongst other things.

And what does our imperturbable chancellor promise if this disgrace of a government is re-elected? True to Tory form, more of the same: austerity for the poor and public services cuts, and tax breaks for the wealthiest.

But further cuts to lifeline benefits and public services is surely untenable. Absolute poverty has risen dramatically, this past four years, heralding the return of Victorian illnesses that are associated with malnutrition. People have died as a consequence of the welfare “reforms”. Supporting the wealthy has already cost the poorest so very much, yet this callous, indifferent, morally nihilistic  government are casually discussing taking even more from those with the very least.

This isn’t anything to do with economic necessity: it’s all about Tory ideology. Under the guise of austerity, the Tory-led Coalition have stripped our welfare and public services down to the bare bones. Any further cuts will destroy what remains of our post-war settlement.

Despite facing a global recession, the Labour Government invested in our public services, and borrowed substantially less in thirteen years than the Coalition have in just three years. UK citizens were sheltered very well from the worst of the global bank-induced crash.

Gordon Brown got it right in his championing of the G20 fiscal stimulus, agreed at the London summit of early April 2010, which was a continuation of his policies that had served to steer the UK economy out of the consequences of a global recession, and to protect citizens from the consequences of cuts to services and welfare.

Osborne’s policy of imposing austerity and budget cuts on an economy that was actually recovering was a catastrophic error. The austerity propelled the economy backwards and into depression; and, far from using public spending as a countervailing force against the cutbacks in private sector investment, the Coalition’s budget cuts served to aggravate the crisis. Many people are suffering terribly as a consequence, reduced to a struggle for survival.

And in these socio-economic circumstances, the Tories have pledged a further £7.2 BILLION tax cuts to the rich. The funding for the tax cuts will come from further catastrophic “savings” made at the expense of the poorest yet again – £25 billion more to be sliced from welfare, Local Authorities,  education, police and other vital services.

Three things are immediately clear. Firstly, without the ramping up of VAT in 2010, to 20%, Osborne would be in even more dire financial straits than he is.

Secondly, income tax has, despite allegedly rising employment, failed to increase.

Thirdly, corporation tax, targeted for cuts, year after year, has slumped. The tax system is increasingly veering toward very regressive – biased in favour of the wealthy – consumption taxes, which affects the poorest, most, and failing to deliver fairer taxes on income.

This is the result of government policy: increasing VAT but cutting corporation tax, and the engineered kind of “recovery” we have ended up with. The Office for Budgetary Responsibility (OBR) reminded us in October of the extent of the Coalition’s failure to reduce the deficit.

Public sector net borrowing in 2013-14 was originally expected to be £60 billion; the out-turn for borrowing was £108 billion (on a comparable basis). This amounts to a shortfall of nearly £50 billion, with borrowing approaching double the original predictions made when the government’s austerity policies were announced in 2010.

Much of this shortfall is accounted for by the current earnings crisis. UK workers are suffering the longest and most severe decline in real earnings since records began in Victorian times, according to an analysis published by the TUC. But Tories always lower wages, and hike up the cost of living. And whilst workers are struggling to make ends meet, private business owners/Tory donors are raking in millions of pounds. But this is exactly how Tories like to run society in a nutshell.

It’s their imposition of a feudalist schemata for social relationships. Cognitively, Tories are the equivalent of historical egocentric toddlers: they are stuck at this painful stage of arrested development.

“The deficit reduction programme takes precedence over any of the other measures in this agreement” – stated in the Coalition Agreement.

For a government whose raison d’etre is deficit reduction, the Coalition really isn’t very good at all. But austerity reflects the triumph of discriminatory Tory ideology over needs-led, evidenced-based policy making.

The OBR said the forecast from 2010 was over-optimistic because it did not take into consideration the effect of lower wages as well as a higher levels of tax-free personal allowance on the upper brackets of income tax. National Insurance contributions were also £7.4 billion below forecast.

Which brings us back to the issue of further tax cuts for the wealthy, with no mention of raising wages for the poorer work-force, and of course there is the promise of more cuts to come for those relying on lifeline benefits. I don’t think that the Coalition cares that their policies don’t balance the books, as it were, or mend the economy. Nor do they care what the consequences are for the wider public.

TUC General Secretary Frances O’Grady said:

The government’s failure to get wages growing again has not only left families far worse off than in 2010, it’s put the public finances in a mess too. The economy has become very good at creating low-paid jobs, but not the better paid work that brings in income tax. The Chancellor’s sums just don’t add up – he can’t make the tax cuts for the better off that he is promising and meet his deficit reduction target without making cuts to public services.

His cuts would be so deep that no government could deliver them without doing damage to both the economy and the fabric of our society. We can’t cut our way out of this problem any more than we can dig ourselves out of a hole. More austerity would only keep us stuck in a downward spiral. The Chancellor should use next week’s Autumn Statement to invest in growth and to put a wages recovery at the top of the agenda.

Shadow Chancellor Ed Balls said:

Nobody will be fooled by pie in the sky promises of tax cuts when David Cameron cannot tell us where the money is coming from. Even the Tories admit this is an unfunded commitment of over £7 billion, so how will they pay for it? Will they raise VAT on families and pensioners again?

Cameron has also announced the basic rate before we start paying tax would rise from £10,500 to £12,500. While a worker on £12,500 would save £500 a year, someone earning £50,000 would keep £1,900 extra.

Those earning up to £123,000 would be £484 richer. Someone on £12,500 would save £500 a year, while someone on up to £50,000 would keep £1,900 extra. And the £500 tax cut for basic rate earners will be almost wiped out by George Osborne’s raid on in-work benefits.

Paul Johnson of the Institute for Fiscal Studies think tank says it was:

very difficult to see how the £7billion tax giveaway could be paid for.

We’re looking at promises of £7billion of tax giveaways in the context of an overall plan to get the deficit down but even without tax giveaways that requires pretty extraordinary levels of spending cuts such that most government departments will see their spending cut by a third by 2020.

How are you going to afford this? Even more dramatic spending cuts?

At the Tory Conference, Cameron promised to expand the National Citizen Service youth project for every teenager in the country, have the lowest rate of corporation tax of any major economy.

There was also a pledge to abolish youth unemployment by the end of the decade. But the Tory faithful gave the loudest applause for his pledge to scrap the Human Rights Act.

This is a truly terrifying pledge, because human rights were originally formulated as an international response to the atrocities of the 2nd World war, and to ensure that citizens are protected from abuses of their government.

A Labour Party analysis found the proposed tax break would hand David Cameron and other Cabinet ministers an extra £132 a year. But a family with two children with one earner on £25,000 a year would lose £495 by 2017-17 due to the benefits freeze announced by Mr Osborne.

The Tory plan is based solely on spending cuts, mainly directed at the working age poor. And the Conservative plan to raise the higher rate threshold to £50,000 means that  working-age poor people are to fund a tax cut that is four times greater for higher rate tax payers than for basic rate taxpayers.

Ed Balls said in response:

David Cameron’s speech showed no recognition that working people are £1,600 a year worse off under the Tories nor that the NHS is going backwards on their watch. The only concrete pledge we’ve had from the Tories this week is a promise to cut tax credits by hundreds of pounds for millions of hard working people while keeping a £3 billion tax cut for the richest one per cent.

TUC general Secretary Frances O’Grady added:

No amount of dressing up can hide the fact that the policies in this speech pass by those who need the most help to reward richer voters.

Alison Garnham, Chief Executive of Child Poverty Action Group, said:

What was missing in the PM’s speech was any recognition that independent projections show that child poverty rates are set to soar. We know that raising the personal tax allowance is an ineffective way of supporting low paid families.Independent analysis shows that just 15% of the £12 billion required to raise the PTA to £12,500 would go to working families in the lowest-income half of the population.

Many simply don’t earn enough to benefit from this policy, and those that do just see their benefits and tax credits withdrawn as their incomes rise.

The Institute for Fiscal Studies showed in their Green Budget publication this year that just 15% of the gains from increasing the personal allowance would benefit the poorest half of Britons, concluding:

There are better ways to help the low paid via the tax and benefit system.

Ex-Treasury official James Meadway,  now a senior economist at the New Economics Foundation, said Cameron’s changes were:

irresponsible, expensive gimmicks that scarcely affect the poorest workers.

They imply swingeing public sector cuts and mean handing over more cash to the already rich.

Ed Miliband will respond tomorrow (Monday), declaring that the Tories’ failure to tackle the cost-of-living crisis has helped cost the Exchequer £116.5 billion – leading to higher borrowing and broken promises on the deficit. The price tag, equivalent to almost £4,000 for every taxpayer, is based on new research from the House of Commons Library being published by the Labour Party.

This shows that low pay and stagnant salaries, combined with soaring housing costs and the failure to tackle root causes of increased welfare bills, means that over the course of this Parliament:

  • Income tax receipts have fallen short of forecasts by more than £66 billion.
  • National Insurance Contributions are £25.5 billion lower than expected.
  • Spending on social security is £25 billion higher than planned [despite brutal cuts to lifeline benefits]

Mr Miliband is expected to say the test for George Osborne in this week’s Autumn Statement will be to set out a plan to build a recovery for working people – one which recognises the link between the living standards and Britain’s ability get the deficit down.

He is expected to say:

For a very long time, our country has worked well for a few people, but not for everyday people. “We live in a country where opportunities are too skewed to those at the top, where too many people work hard for little reward, where too many young people can’t find a job or apprenticeship worthy of their talents, and where families can’t afford to buy a home of their own.

For all the Government’s boasts about a belated economic recovery, there are millions of families still caught in the most prolonged cost-of-living crisis for a century.  For them this is a joy-less and pay-less recovery.

My priority as Prime Minister will be tackling that cost-of-living crisis so that hard work is properly rewarded again, so that our children can dream of a better future, so that our public services including the NHS are safe.

Building a recovery that works for everyday people is the real test of the Autumn Statement.

But that isn’t a different priority to tackling the deficit. Building a recovery that works for most people is an essential part of balancing the books.

The Government’s failure to build a recovery that works for every-day people and tackle the cost-of-living crisis isn’t just bad for every person affected, it also hampers our ability to pay down the deficit.

Britain’s public finances have been weakened by a Tory-led Government overseeing stagnant wages which keep tax revenues low.

Britain’s public finances have been weakened by Tory policies which focus on low paid, low skilled, insecure jobs – often part-time or temporary – because they do not raise as much revenue as the high skill, high wage opportunities we need to be creating.

And our public finances have been weakened by higher social security bills to subsidise low paid jobs and the chronic shortage of homes.   

The result has been David Cameron and George Osborne missing every single target they set themselves on clearing the deficit and balancing the books by the end of this parliament.

Their broken promises, their abject failure, are not an accident. They are the direct result of an outdated ideology which says all a Government has to do is look after a privileged few at the top and everyone else will follow.

That is why this Government has done a great job of squeezing the middle, but a bad job of squeezing the deficit.

The test this week for David Cameron and George Osborne is whether they recognise that Britain will only succeed and prosper for the long term by tackling the cost-of-living crisis and building a recovery which works for the many, not just for a few.

Or whether they will just offer more of the same old ideas that have failed them, failed everyday working people, and failed Britain over the past four years.

The largest study into poverty in the UK has prompted fresh urges for the government to take measures to tackle growing levels of poverty. The Poverty and Social Exclusion in the United Kingdom (PSE) project is a collaboration between the University of Bristol, University of Glasgow, Heriot Watt University, Open University, Queen’s University (Belfast), University of York, the National Centre for Social Research and the Northern Ireland Statistics and Research Agency.

The project commenced in April 2010 and will run for three-and-a-half years. The research has revealed that inequality in the UK is growing.

The research paper presents an analysis of child poverty and social exclusion in the UK, drawing on data from the 2012 Poverty and Social Exclusion Survey and is the final report on this element of the PSE project. It advances the measurement of child poverty by using three different measures: a child deprivation measure, based on socially perceived necessities, the conventional income poverty measure (but with a more realistic equivalence scale) and a PSE measure which combines deprivation and low income.

The research finds the rates of child poverty for each measures are similar at 30%, 33% and 27% respectively. It also finds, from a new analysis of intra-household distribution, that child deprivation would be much higher if parents were not sacrificing their own living standards for the sake of their children. Analysing the characteristics of poverty, it confirms that a majority of poor children are now living in households with someone in employment.

Perhaps this is the most interesting revelation unearthed by the report: the fact that most of the people living in poverty are employed, dispelling the myth perpetuate by Tory ministers that poverty is a consequence of “worklessness”.

The research found that the majority of children living below the breadline live in small families with at least one employed parent.

Almost 18 million people are unable to afford adequate housing, while one in three do not have the money to heat their homes in winter.

Professor David Gordon said: “The Coalition government aimed to eradicate poverty by tackling the causes of poverty. Their strategy has clearly failed. The available high quality scientific evidence shows that poverty and deprivation have increased since 2010, the poor are suffering from deeper poverty and the gap between the rich and poor is widening.”

We know that benefit delays and the grossly punitive sanction regime are causing dire hardship for people who claim out-of-work benefits, including disabled people  who are deemed unfit for work by their doctor.

We are not simply talking about relative deprivation, here, which is more of a statement about degrees of social exclusion. We are talking about absolute poverty, which is a measure of how many can’t afford basic necessities to support life – food, fuel and shelter.

There are many current studies about poverty, all of which conclude pretty much the same: that poverty and inequality are rising, that people are struggling to meet their most basic needs, and that those who were already the poorest citizens have been hit the hardest by Coalition cuts

The problem isn’t that the government “aren’t doing enough” to tackle poverty: the real problem is that Tory policies are creating poverty.

Three things are immediately clear. Firstly, without the ramping up of VAT in 2010, to 20%, Osborne would be in even more dire financial straits right now. Secondly, income tax has, despite apparently rising employment, failed to increase. Thirdly, corporation tax, targeted for cuts, year after year, has slumped.

The tax system is increasingly veering toward very regressive – biased in favour of the wealthy – consumption taxes, and failing to deliver fairer taxes on income. This is a result of government policy, increasing VAT but cutting corporation tax, and the engineered kind of “recovery” we have ended up with.

We know that austerity is not an economic necessity, as claimed by the Coalition: it’s a Tory ideological preference, aimed at fulfilling a Tory obsession: “shrinking the State“.

We also know that Cameron, who rested all of his political credibility on “paying down the debt” hasn’t done so. In fact, he’s increased it, and the Coalition have borrowed more in just the first three years in Office than the Labour Party – faced with a global banking crisis – did in their entire thirteen years in Office.

If we scrutinise the Coalitions’s policies, which very clearly reflect their ideology, it becomes difficult to see how they could do anything but create inequality and poverty:

These cuts, aimed at the poorest, came into force in April 2013:

  • 1 April – Housing benefit cut, including the introduction of the bedroom tax
  • 1 April – Council tax benefit cut
  • 1 April – Legal Aid savagely cut
  • 6 April – Tax credit and child benefit cut
  • 7 April – Maternity and paternity pay cut
  • 8 April – 1% cap on the rise of in working-age benefits (for the next three years)
  • 8 April – Disability living allowance replaced by personal independence payment (PIP)
  • 15 April – Cap imposed on the total amount of benefit working-age people can receive.

At the same time, note the Tory “incentives” for the wealthy:

  • Rising wealth – 50 richest people from this region increased their wealth by £3.46 billion last year to a record £28.5 billion.
  • Falling taxes – top rate of tax cut from 50% to 45% for those earning over £150,000 a year. This is 1% of the population who earn 13% of the income.
  • No mansion tax and caps on council tax mean that the highest value properties are taxed proportionately less than average houses.
  • Benefited most from Quantitative Easing (QE) – the Bank of England say that as 50% of households have little or no financial assets, almost all the financial benefit of QE was for the wealthiest 50% of households, with the wealthiest 10% taking the lions share
  • Tax free living – extremely wealthy individuals can access tax avoidance schemes which contribute to the £25bn of tax which is avoided every year,as profits are shifted offshore to join the estimated £13 trillion of assets siphoned off from our economy.
  • Millionaires were awarded a “tax break” of £107,000 each per year.

This year, research from the Office of National Statistics showed that the quantity of food bought in food stores also decreased by 1.5 per cent year-on-year in July.

It doesn’t take a genius to work out that repressed, stagnant wages and RISING living costs are going to result in reduced sale volumes. Survation’s research in March this year indicates that only four out of every ten of UK workers believe that the country’s economy is recovering. But we know that the bulk of the Tory austerity cuts were aimed at those least able to afford any cut to their income.

Once again, what we need to ask is why none of the mainstream media articles, or the Office of National Statistics account, duly reporting the drop in food sales, have bothered to link this with the substantial increase in reported cases of malnutrition and related illnesses across the UK.

It’s not as if this correlation is a particularly large inferential leap, after all.

No-one should be hungry, without food in this country. That there are people living in a politically imposed state of absolute poverty is unacceptable in the UK, the world’s sixth largest economy (and the third largest in Europe). This was once a civilised first-world country that cared for and supported vulnerable citizens. After all, we have paid for our own welfare provision, and we did so in the recognition that absolutely anyone can lose their job, become ill or have an accident that results in disability. This is a Government that very clearly does not reflect the needs of the majority of citizens.

It is also unacceptable in a so-called liberal democracy that we have a Government that has persistently denied the terrible consequences of their own policies, despite  overwhelming evidence that the welfare “reforms” are causing people, harm, distress and sometimes, death. Furthermore, this is a Government that has systematically employed methods to effectively hide the evidence of the harm caused to others as a consequence of their devastating, draconian “reforms” from the public. This clearly demonstrates an intention to deceive, and an intention to continue causing people harm.

Cameron told us in 2012, in a rare moment of truth (albeit an unintentional one),  that he is raising more money for the rich. That money has been raised because as their policies indicate clearly, the Tories have taken it from the poorest.

How many policy-related deaths does it take to change a government?

What will it take for the wider public to recognise a despotic regime for what it is: a government that does not democratically reflect the needs of most citizens in the UK, one that is inflicting unforgivable punishment on those that our society once protected?

What kind of government causes harm to citizens?

With the hierarchical ranking in terms of “deserving” and “undeserving” poor, the artificial and imposed framework of Social Darwinism: a Tory rhetoric of division, where some people’s worth matters more than others, how do we, as conscientious campaigners, help the wider public see that there are no divisions based on some moral measurement, or character- type: there are simply people struggling and suffering in poverty, who are being dehumanised by a callous, vindictive Tory government that believes, and always has, that the only token of our human worth is wealth.

Tory policies ensure that the wealthy are rewarded with more wealth and they punish the poorest with grinding, unforgiving, unforgivable absolute poverty.

Conservatism in a nutshell

It’s not enough to challenge Tory ideology. We also have to dismantle the Orwellian semantic thrifts and shifts. We have to defeat the Tory propaganda machine that lies, persuades and lulls people with meaningless populist slogans, empty glittering generalities and glib catch-phrases.

You’ve heard those slogans – “less government”, “personal responsibility”, “hard-working families”, “making work pay” and lots of nationalist flag waving. These are shorthand messages to the public that are thrifty with the truth, codifications for an entire world-view. But it’s ever such a shabby, ruthless, isolating and paltry one.

The clue is in the name: the word “Tory” derives from the Middle Irish word tóraidhe, which means outlaw, robber or brigand, from the Irish word tóir, meaning “pursuit”, since outlaws were “pursued men”. It was originally used to refer to an Irish outlaw and later applied to Confederates or Royalists in arms. The term was originally one of abuse.

The Tories live by plundering. They steal your taxes, your public services, your state provision and your labour in order to raise more money for the rich. They have reneged on our post war democratic settlement. Legal aid, human rights, social housing, the NHS, lifeline welfare support – the essential components of any functioning democracy – are being viciously and systematically dismantled by the Tories. 

It’s a dystopic world of corporate fiefdom. I heard a very smart person from the States once sum up the Tories neatly with the phrase “cheap-labour conservatism”. How very apt. It fits so well. It makes sense of such a lot.

Basically, the larger the labour supply, the cheaper it is. The more desperately you need a job, the less you tend to demand for your wages to be fair, and the more power those big business Tory buddies have over you. This is what the Tories actually mean by “making work pay” – it’s either rationed out peanuts or starvation. But for big business, your work pays them handsomely in fat profits.

The Tories engineer this same socioeconomic situation every time they are in office. Think back to the Thatcher era, she did it, Major did it – it’s a manufactured recession and a large reserve army of cheap labour every time. ALWAYS the same with the Tories. Because it suits their “business friendly” agenda.

That’s another Tory slogan that means corporate greed, profit before people and Tory donations – see the Beecroft Report, for example, written by a British “venture capitalist” that has donated more than £500,000 to the Conservative Party. The overdogs write policies to make sure that we remain the underdogs. Fat profits are all that matter to the vulture capitalists. 

Beecroft is currently Chairman of Dawn Capital. The release in May 2012, of the long awaited Beecroft Report in the UK caused considerable controversy because it recommended that the government should “cut red tape” in order to make the hiring and firing of employees easier and cheaper.

The report claimed this would help to ‘boost’ the economy although no evidence for this was provided. It’s hard to imagine how increasing job insecurity would encourage workers to spend their money. It does, however, help boost profits for venture  vulture capitalists, and the government-commissioned report strips workers of their rights.

As the TUC said at the time, the ideas have taken the UK back towards Victorian era working conditions and standards. Conservatives don’t like social spending or welfare – our safety net. The safety net we funded. That’s because when you’re unemployed and desperate, companies can pay you whatever they feel like – which is inevitably next to nothing, so their profits can grow. 

You see, the Tories want you in a position to work for next to nothing or starve, so their business buddies can focus on feeding their profits, which is their only priority.

Cheap-labour conservatives don’t like the minimum wage, or other improvements in wages and working conditions. These policies undo all of their efforts to keep you desperate. They don’t like European Union labour laws and directives either, for the same reason.

Cheap-labour conservatives don’t like unions, because when we unite, organise and collectively bargain, wages go up and living standards rise. Working conditions improve. That’s why workers unionise. Seems workers don’t like being desperate.

But businesses don’t like to pay out money. They like to hoard it. Cheap-labour conservatives constantly bray about “morality”, “virtue”, “respect for authority”, “hard work”, “responsibility” and other such vaguely defined values. This is only so that they can blame you for being desperate due to your own “immorality”, “lack of values”, “lack of character” , “idleness” and “poor life-choices”  when you are poor, within a system designed to generate a few ‘winners’ and a lot more ‘losers’. It’s not a level playing field that hosts the great neoliberal ‘competition’.

Those inane soundbites have been used to dismantle another worker’s protection: the welfare state.

They have also been deployed so that the Tories can justify their “business friendly” workfare schemes to further exploit the reserve army of labour and keep us desperate, unpaid and in our place.

Cheap-labour conservatives encourage racism, misogyny, homophobia and other forms of bigotry. That’s because bigotry among wage earners distracts them, and keeps them from recognising their common interests as wage earners. Divide and rule was invented by cheap labour-conservatives. To keep labour cheap.

An ugly truth is that cheap-labour conservatives don’t like working people. They don’t like working class opportunities and prosperity, and the reason for this is very simple. Lords have a harder time kicking us around when we aren’t desperate, hungry and in fear of destitution.

Once we understand this about the cheap-labour conservatives, the real motivation for their policies makes perfect sense. Cheap-labour conservatives, the neo-feudalist fools, believe in social hierarchy and limited privilege, so the only prosperity they want to permit is limited to them and their elite class.

They want to see absolutely nothing that benefits us whatsoever. And even better if we fight amongst ourselves for scraps. Divide and rule. The Tory mantra “making work pay” is an argument for RAISING WAGES, not cutting benefits, talk about the rationally illiterate …. But then cheap-labour conservatives hope that those affected will take comfort in the fact that if your wages are not enough to meet the cost of living, at least those without a job are much worse off.

The Tory “race to the bottom” is hidden in plain view, and after five years of austerity, Osborne is forced to concede that the new welfare cuts leave £9bn of the deficit reductions promised by the Chancellor unaccounted for. The cuts are PURELY ideological. Tories: dangerous with the economy, dangerous for society.

“Less government” is another defining right-wing slogan. It’s also all about cheap labour. Referenced by the slogan is the whole conservative set of assumptions about the nature of the “free market” and government’s role in that market. However, we pay for government. We pay for protective state services. It is not the government’s money to hand out to millionaires, it is ours. 

The slogan “less government” permitted the conservatives’ cunning transformation of a crisis caused by banks into a crisis of public spending. It was a huge triumph of Tory dogma over the facts. And of course, our public services are being sold off to private companies. A few people are quietly making megabucks while the rest of us are told to “live within our means.”

And anyone would think, to hear the Tories talk, that the “free-market” isn’t rigged to benefit the wealthy. There’s no such thing as an “invisible hand”, unless you count the iron fist of the authoritarian state, getting on with getting their own way. The bedroom tax, welfare cuts, public service cuts, cutting inheritance tax and handing out tax breaks to the wealthy are, after all, examples of state interventions, and not “market forces”, which the Tories always use as a front to suck the life out of entire communities and to keep people desperate.

The whole “public sector/private sector” distinction is an invention of the cheap-labour conservatives. They say that the “private sector” exists outside and independently of the “public sector”. The public sector, according to cheap-labour ideology, can only “interfere” with the “private sector”, and that such “interference” is “inefficient”, “costly” and “unprincipled”.

Using this ideology, the cheap-labour ideologue paints him/her self as a defender of “freedom” against “big government tyranny,” while all the time, the conservatives are extending an extreme, oppressive authoritarianism.They have to because no ordinary person who knows what they’re up to actually wants their policies. And in fact, the whole idea that the “private sector” is independent of the public sector is totally bogus, because “the market” is created by public laws, public institutions and public infrastructure. 

But the cheap-labour conservative isn’t really interested in “freedom”. What they want is the privatised tyranny of industrial and financial serfdom, the main characteristic of which is – you guessed it – cheap labour.

UK becomes the first country to face a UN inquiry into violations of disabled peoples’ human rights

We ought to be very concerned about the government’s declaration that they intend to withdraw from the European Convention on Human Rights, (ECHR) and to repeal our own Human Rights Act, (HRA). One has to wonder what Cameron’s discomfort with the HRA is. The Act, after all, goes towards protecting the most vulnerable citizens from neglect of duty and abuse of power. The rights protected by the HRA are drawn from the 1950 European Convention on Human Rights, which was a way of ensuring that we never again witness the full horrors of the second world war, and overwhelmingly, one of the greatest stains on the conscience of humanity – the Holocaust.

Human Rights establish a simple set of minimum standards of decency for humankind to hold onto for the future. The European Convention on Human Rights and Fundamental Freedoms was drafted as a lasting legacy of the struggle against fascism and totalitarianism, as well as the atrocities of world war 2.

What kind of government would want those basic protections for citizens overturned?

One that doesn’t value or wish to uphold the universal protection of its citizens. From the State.

Last month, a new report, Dignity and Opportunity for All: Securing the Rights of Disabled People in the Austerity Era – Jane Young is the lead author – exposed the Coalition’s failure to meet its international human rights obligations under both the UN Convention on the Rights of People with Disabilities (UNCRPD) and the International Covenant on Economic, Social and Cultural Rights (ICESCR).

The report – also published by the Just Fair Coalition, a consortium of 80 national charities including Amnesty International, Save the Children, and Oxfam, says the UK is in clear breach of its legal obligations. Support structures for many disabled people have disappeared or are under threat as local authorities cut social care budgets, while cuts to social security will leave many disabled people without lifeline support for daily living.

Jane Campbell, a cross-bench peer who is disabled herself, said: “It is both extremely worrying and deeply sad that the UK – for so long regarded as an international leader in protecting and promoting disabled people’s rights – now risks sleepwalking towards the status of a systematic violator of these same rights.”

The UK government seems to be the first to face such a high-level international inquiry, initiated by the United Nations Committee because of “grave or systemic violations” of the rights of disabled people. That ought to be a source of shame for the Coalition, especially considering that this country was once considered a beacon of human rights, we are (supposedly) a first-world liberal democracy, and a very wealthy nation, yet our government behave like tyrants towards the poorest and some of the most vulnerable citizens of the UK.  As disability specialist, campaigner and first-class human rights activist, Samuel Miller says: “Britain is [now] a retrograde society and a flagrant violator of human rights—especially the rights of the sick and disabled”. 

It’s because of the sterling work of people such as Mr Miller that the UN have been made aware of our dire situation, here in the UK. Many of us have contacted the UN and made submissions, detailing the detrimental impacts that punitive Tory policies such as the bedroom tax, other welfare “reforms” (cuts), including the increasing use of extremely punitive welfare sanctions which leave people without the means to meet their most basic survival needs, the draconian Work Capability Assessment, brutal Tory targets for reducing spending and local authority cuts, for example, are having on ill and disabled people.

This is a government who refuse to undertake a cumulative impact assessment of their “reforms” and also continue to dismiss any evidence provided that challenges their own glib and deceitful account as “anecdotal” or “scaremongering”. Yet we are expected to regard Tory soundbites such as the “culture of entitlement” and the “something for nothing culture” which are ideologically motivated rather than   resting on some sort of empirical evidence. The Tories believe that their opinions alone somehow justify the cruel removal of people’s lifeline benefits and support. 

There’s more than one issue here, though it’s plain that the government have no intention of addressing any of the terrible consequences of their draconian policies, and use denial and stigmatising others to deflect attention from their aims. I am reminded of Techniques of Neutralisation – a well known collection of tactics used historically to justify prejudiced views, discriminatory and oppressive policies and  despotic actions.

Another related and important issue is that people’s qualitative experiences should matter to any decent democratic government, but the Coalition is far more concerned with its persistent attempts at DISCREDITING those experiences, (such attempts to invalidate and exclude the narrative of experiences of previously and presently marginalised people is a hallmark of the oppressive, supremacist condescension of historically powerful and privileged groups) –  denying their victims a voice and remedy. We know that this is not a democratic government that serves its citizens and reflects their needs, equally or otherwise.

Thanks to the sterling work of Dr Simon J Duffy, from the Centre for Welfare Reform, among others, we know that the austerity measures in the UK have disproportionately affected those people with disabilities and their carers. Dr Duffy’s work on the impact of the austerity cuts shows us that:

  • People in poverty are targeted 5 times more than most citizens
  • Disabled people are targeted 9 times more than most citizens
  • People needing social care are targeted 19 times more than most citizens

Yet, this government claims a cumulative impact assessment is “too difficult and costly”, I suggest that they use their considerable publicly donated, tax-collected wealth to fund the work of the Centre for Welfare Reform, who managed to undertake this work without hitting the obstacles the government claims it has. This said, perhaps the findings are the real obstacle that the government are concerned about. Because those findings are damning, and tell us that the welfare “reforms” are NOT “fair” as claimed, and are causing harm, distress, hardships and sometimes, death. The grossly punitive, draconian “reforms” need to be repealed.

The UN Committee has the power to launch an inquiry if it receives “reliable information” that violations have been committed, and as the Labour Government signed up to the protocol in 2009 – the UNCRPD and the international covenant on economic, social and cultural rights – it is legally binding. Many of us have used the Optional Protocol to the Convention on the Rights of Persons with Disabilities to send communication and make submissions since 2012.

Austerity measures and welfare “reforms” such as the bedroom tax (which is in itself established by the UN as being a contravention of human rights law) mean the rights of disabled people to independent living, work, and adequate social security have been seriously undermined, causing significant hardship and harm, quite often leading to tragic consequences.

Such investigations are necessarily conducted “confidentially”, so the UNCRPD  has formally refused to confirm or deny that the UK is being investigated. However, a recording has emerged (one hour and twenty five minutes long, watch from one hour and four minutes) of a former CRPD member seemingly revealing that the inquiry has been launched.

Professor Gabor Gombos, who is the co-founder of Voice of Soul, Hungary’s first organisation for ex-users and survivors of Mental Health Institutions, and co-chair of the World Network of Users and Survivors of Psychiatry, can be heard informing the audience that CRPD has “started its first inquiry procedure against the United Kingdom”.

He informs the Sixth International Disability Law Summer School at the National University of Ireland in Galway, June, that inquiries are only used where there are suspicions of “grave” violations of human rights. He says: “Where the issue has been raised and the government did not really make effective actions to fix the situation – it is a very high threshold thing – the violations should really be grave and very systemic.”

Earlier this year, the level of UK benefits paid in pensions, jobseeker’s allowance and incapacity benefits was deemed “manifestly inadequate” because it falls below 40% of the median income of European states, by the Council of Europe in Strasbourg.

The finding in an annual review of the UK’s adherence to the council’s European social charter is likely to provoke a fresh dispute between the government and European legal structures. Iain Duncan Smith, the work and pensions secretary, dismissed it as “lunacy”.

Not an open, accountable minister, or government, then.

The Council of Europe, which has 47 member states, said the conclusions were legally binding in the same way that judgements relating to the European Convention on Human Rights had to be applied by member states.

Aoife Nolan, professor of International Human Rights Law at the University of Nottingham and a trustee of Just Fair said government policies were compromising disabled people’s human rights.

“Not only do these policies cause significant hardship and anxiety, but they also amount to impermissible backward steps in relation to disabled people’s human rights, contrary to the UN human rights framework.”

The report was submitted to the United Nations, which, as I’ve previously outlined in earlier articles here, is in the process of reviewing UK compliance with its obligations to the rights of disabled people.

Last year, Amnesty International condemned the erosion of human rights of disabled people in UK, and the Joint Parliamentary Committee on Human Rights conducted an inquiry into the UK Government’s implementation of Article 19 of the United Nations Convention on the Rights of Persons with Disabilities – the right to live independently and to be included in the community. The inquiry, which began in 2011, has received evidence from over 300 witnesses.

The inquiry highlighted just how little awareness, understanding and employment of the Convention there is by the Tory-led government. Very few of the witnesses made any specific reference to the Convention in their presented evidence, despite the inquiry being conducted by the Parliamentary Human Rights Committee, with the terms of reference clearly framing the inquiry as being about Article 19 of the UNCRPD.

“This finding is of international importance”, said Oliver Lewis, MDAC Executive Director, “Our experience is that some Governments are of the view that the CRPD is nothing more than a policy nicety, rather than a treaty which sets out legal obligations which governments must fulfil.”

The report is particularly critical of the Minister for Disabled People (Maria Miller, at the time) who told the Committee that the CRPD was “soft law”. The Committee criticised this as “indicative of an approach to the treaty which regards the rights it protects as being of less normative force than those contained in other human rights instruments.” (See the full report.) The Committee’s view is that the CRPD is hard law, not soft law. 

Quite properly so. The whole point of human rights legislation is that it is universally applied, regardless of characteristics, preferences or belonging to a specific community or social group. The Tories seem to believe that poor people, disabled people and those with mental and physical illness should enjoy fewer rights than others.

Dr Hywel Francis MP, Chair of the Committee, said: “We are concerned to learn that the right of disabled people to independent living may be at risk through the cumulative impact of current reforms. Even though the UK ratified the UNCPRD in 2009 with cross-party support, the Government is unable to demonstrate that sufficient regard has been paid to the Convention in the development of policy with direct relevance to the lives of disabled people. The right to independent living in UK law may need to be strengthened further, and we call on the Government and other interested organisations to consider the need for a free-standing right to independent living in UK law.”

“The Government is meant to include disabled people in making sure people have their human rights upheld. We are concerned that a part of the Law on treating people equally and fairly (Equality Act section 149) does not say any more that disabled people should be involved. This is a step backwards.”

In other words, the Tory-led Coalition has quietly removed this part of the Equality Act.

The budget of the Equality and Human Rights Commission (EHRC), which was established by the Labour Party when they were drafting this flagship policy, is being reduced by over 60%, its staffing cut by 72%, and its powers restricted by the Coalition. Provisions that are being repealed by the Enterprise and Regulatory Reform (ERR) Bill include the duty on public authorities to have due regard to the need to reduce socioeconomic inequalities.

Savage Legal aid cuts from April 2013 have also contributed significantly to creating further barriers to ensuring Equal Rights law protect us, and the Tory-driven Legal Aid Bill also contravenes our right to a fair trial under Article 6(1) of the European Convention on Human Rights.

This is not a coincidental multiple policy timeline, but rather a very coordinated political attack on potential legal challenges at a time when Tory-led severe and devastating multiple welfare and provision cuts have affected disabled people so disproportionately. The changes, which came into effect in April, will hit “the same group of disabled people over and over again”. 

Our political freedoms and human rights must not be subservient to Tory notions of ‘economic success’. Democracy is not about the private accumulation of wealth of a few millionaires at the expense of others. It is about the wise use of the collective wealth – pubic funds – for the common good of the public – that must extend to include ALL of our citizens. And a decent, civilised, democratic society supports its vulnerable members and upholds universal human rights.

We need to ask why our government refuses to instigate or agree an inquiry into the substantial rise in deaths among ill and disabled people, as these deaths are quite clearly a correlated consequence of this government’s policies.

What kind of government uses the media to scapegoat and stigmatise ill and disabled people, by lying and inventing statistics to “justify” the persecution of our most vulnerable citizens, and the withdrawal of their crucial lifelines and support?

One that does not value those lives, or regard them as having an equal worth with others.

It is my understanding that a 22-page letter, pointing out that cuts to social security benefits introduced by Iain Duncan Smith and enforced by his Department for Work and Pensions on behalf of the Coalition government may constitute a breach of the UK’s international treaty obligations to the poor, will also be discussed at a meeting of the UN Human Rights Council in New York, in September. It is signed by Raquel Rolnik, the former UN special rapporteur on adequate housing; Magdalena Sepúlveda Carmona, the former UN special rapporteur on extreme poverty; and Olivier De Schutter, the former UN special rapporteur on the right to food.

Could you please add, as an addendum to that letter, my partial bibliography on Britain’s benefit-sanctioning regime, which is attached below in PDF format. My views can be found on page two; I am extremely concerned about the British government’s soaring use of benefit sanctions, and the evidence from MPs and the Work & Pensions Committee, which provides oversight of the Department for Work and Pensions, is especially compelling and strongly suggests that the government is stitching-up benefit claimants and is involved in a cover-up of that fact. The refusal of the government to agree to the Work & Pensions Committee’s request for an independent inquiry into this matter only compounds suspicion.

In closing, I would be most appreciative if the Human Rights Council and the OHCHR would open an investigation into this matter. The last Labour government introduced a host of measures to strengthen the rights of our most vulnerable groups – in particular they protected the rights of disabled people. They formulated the Human Rights Act 1998. They passed the Disability Discrimination Act 2005, introduced the Equality Act 2010, formed the Equality and Human Rights Commission, and, in 2009, the Labour government signed the United Nations convention on the rights of persons with disabilities.

The few successful cases we have seen brought against the Tories are down to these Labour laws. We mustn’t lose sight of that. And I’ve every faith that a Labour government will address the gross injustices extended by the draconian of this government, using the existing laws, and their currently proposed policy of prosecuting people for hate speech against the vulnerable.
